App refers to the DocSelect mobile application or web platform that provides access to healthcare services, appointment bookings, and related functionalities.

User refers to any individual who uses the DocSelect app, either by registering an account or by using the app to book appointments or access services.

Services refer to the healthcare services available through the DocSelect app, which may include GP consultations (in-person or remote), health management plans, appointment scheduling, and any other services provided by DocSelect.

Clinician refers to a healthcare professional, such as a General Practitioner (GP), employed or contracted by DocSelect to provide services to users through the app.

You/Your refers to the user of the DocSelect app, which may be an individual using the app themselves or someone acting on behalf of a dependent (e.g., a parent booking appointments for a child).
1.1 These Terms and Conditions (the “Agreement”) govern your use of the DocSelect app and any services provided through the app by Eligo Medical Services Ltd, trading as DocSelect (“DocSelect”, “we”, “our”). By accessing or using the DocSelect app, you agree to comply with these Terms and Conditions and all applicable laws and regulations. If you do not agree to these terms, you should not use the app or any associated services.
1.2 This Agreement applies to all users of the DocSelect app, including both registered users and those using the app to book appointments or access healthcare services, regardless of whether the services are paid for under a subscription or pay-as-you-go model.
1.3 DocSelect reserves the right to update or modify these Terms and Conditions at any time. Any changes will be communicated to you via the app, email, or through our website. By continuing to use the app after any changes are made, you accept the updated terms.
1.4 The terms outlined in this Agreement form the entire contract between you and DocSelect regarding your use of the app and the services provided. This supersedes any previous agreements or understandings, whether written or oral.
2.1 By downloading, installing, or using the DocSelect app, or by booking any appointments or accessing any services provided through the app, you agree to be bound by these Terms and Conditions.
2.2 If you do not agree to these Terms and Conditions, you should not use the DocSelect app or any associated services.
2.3 DocSelect reserves the right to modify, update, or amend these Terms and Conditions at any time. Any changes will be communicated through the app, via email, or on our website. By continuing to use the app or the services after the updated terms have been posted, you agree to accept the revised terms.
2.4 You are responsible for reviewing these Terms and Conditions regularly. Any changes to these terms will become effective upon posting. If you disagree with any part of the revised terms, you must cease using the app and services immediately.
3.1 Account Creation and Maintenance
You are responsible for creating and maintaining an accurate, up-to-date account to access the services provided by DocSelect. This includes providing accurate personal information (such as your name, address, and contact details) and ensuring that your account details are kept secure.
3.2 Booking and Managing Appointments
You are responsible for making appointments, whether through the subscription plan or on a pay-as-you-go basis. For pay-as-you-go appointments, you must ensure payment is made at the time of booking. For minors under 16, all bookings must be made through an adult’s account, and the adult is responsible for managing appointments.
3.3 Use of Services
You agree to use the services provided by DocSelect in a lawful manner and for the purpose for which they are intended. This includes complying with all applicable laws and guidelines, as well as adhering to any instructions provided by our clinicians or staff.
3.4 Security and Confidentiality
You are responsible for ensuring that your login credentials and account information remain confidential and secure. If you become aware of any unauthorised access to your account, you must notify DocSelect immediately to help us protect your account and personal data.
3.5 Appropriate Use of Services
You agree not to use the DocSelect services for any unlawful, harmful, or disruptive purpose. This includes but is not limited to:

Misusing the services for commercial or illegal activities.
•
Attempting to gain unauthorised access to any part of the app or related systems.
•
Engaging in any activity that may harm, disrupt, or compromise the app, services, or other users’ experience.
3.6 Responsibility for Health Information
You are responsible for providing accurate health information and ensuring that all relevant details are shared with the clinicians when booking or attending appointments. This is necessary for the clinician to provide safe and appropriate care. Failure to provide accurate information may affect the quality of care you receive and could result in the cancellation or termination of the service.
3.7 Appropriate Technology and Equipment
It is your responsibility to ensure that you have the correct technology, devices, and internet connectivity required to access and use the services effectively, particularly for remote consultations. If you are under 16, the responsible adult must ensure that the necessary technology is available for the appointment.
3.8 Appointment Cancellations
You agree to cancel appointments in a timely manner in accordance with the cancellation policy specified in these Terms and Conditions. Failure to cancel within the required time frame may result in a charge for the missed appointment, as outlined in our Cancellation and Refunds section.
3.9 Respectful Behaviour
You must treat DocSelect clinicians, staff, and other users with respect. Abusive or inappropriate behaviour towards any member of the DocSelect team or other users will not be tolerated and may result in suspension or termination of access to the services.
3.10 Compliance with Terms and Conditions
You agree to comply with all aspects of these Terms and Conditions, as well as any other policies, procedures, or guidelines provided by DocSelect during your use of the app and services.
4.1 General Overview of Services
DocSelect provides access to a range of healthcare services through its app, including but not limited to GP consultations (in-person and remote), health assessments, and other general medical services. These services are available through two main models: Subscription Plans and Pay-As-You-Go Appointments.
4.2 Subscription Plans
DocSelect offers subscription-based plans that allow users to access ongoing healthcare services over a defined period (e.g., monthly or annually). Subscription services grant users the ability to book appointments, receive consultations, and access other healthcare-related features as specified within their plan.
4.3 Pay-As-You-Go Appointments
For users who prefer not to commit to a subscription, Pay-As-You-Go Appointments are available. These appointments are booked and paid for individually, with no long-term commitment required. Payment for these services is due at the time of booking.
4.4 General Medical Services
In addition to subscription and pay-as-you-go appointments, DocSelect may provide other general medical services as determined by the needs of users. These services may include but are not limited to medical advice, referrals, health assessments, and other healthcare support services.
4.5 Service Modifications
DocSelect reserves the right to modify, update, or discontinue any of the services provided at any time. This includes changes to the scope of services available under subscription or pay-as-you-go models. DocSelect will endeavour to notify users of any significant changes via email, the app, or through other communication channels. By continuing to use the services, you accept any modifications made to the services.
4.6 Service Availability
Services provided through the app are subject to availability, and DocSelect makes no guarantee of uninterrupted or continuous availability of any particular service. DocSelect may also limit service access based on factors such as geographic location, service capacity, or user eligibility.
5.1 Payment Terms
Payment for services, including Pay-As-You-Go Appointments and Subscription Plans, is governed by the Pay-As-You-Go and Subscription T&Cs, as applicable. Please refer to the relevant Terms and Conditions for details regarding payment processing, billing cycles, and any applicable charges.
5.2 Payment Methods
We accept various payment methods for both Pay-As-You-Go and Subscription services. For full details, please refer to the Payment and Billing section in the Pay-As-You-Go and Subscription Terms and Conditions.
6.1 Cancellation Policy
The cancellation and refund policy for all bookings is outlined in the Pay-As-You-Go and Subscription T&Cs. Please refer to those documents for the specific terms regarding cancellations, rescheduling, and refunds.
6.2 Refunds
Refunds for Pay-As-You-Go appointments and Subscription Plan services are subject to the terms in the relevant agreements. Please refer to the Cancellations and Refunds section in the Pay-As-You-Go and Subscription T&Cs for further details.
7.1 Data Collection
DocSelect collects and processes personal data, including health-related information, that is necessary to provide healthcare services and manage your health needs. This may include, but is not limited to, personal details (such as name, address, and contact information) and medical information (such as health history, diagnoses, treatments, and consultation notes).
7.2 Purpose of Data CollectionThe data we collect is used exclusively for providing healthcare services to you. This includes, but is not limited to,:

Managing and delivering healthcare services (e.g., booking appointments, providing medical advice and consultations, and managing treatment plans);
• Communicating with you regarding your appointments and health needs;

Improving and personalising our services based on your health information;

Complying with any regulatory or legal obligations (such as maintaining health records).
7.3 Data Retention
DocSelect will retain your personal and health data for as long as necessary to fulfil the purpose for which it was collected, including any legal, accounting, or reporting requirements. When data is no longer required, it will be securely deleted in accordance with our data retention policies.
7.4 Data Security
We take the protection of your personal data seriously and implement appropriate technical and organisational measures to safeguard it. These measures include encryption, secure access controls, and regular security reviews to ensure your data is kept safe.
7.5 Sharing of Data
Your personal and health data may be shared with healthcare providers, clinicians, or other third parties involved in delivering your care, but only to the extent necessary to provide the services. We will never sell or trade your personal data.
7.6 Third-Party Services
DocSelect may use third-party service providers to help manage certain aspects of the services, such as appointment bookings, payment processing, or data storage. These third-party providers are required to comply with data protection laws and maintain the confidentiality of your data.

8.1 Limitations on Liability
DocSelect provides its services with reasonable skill and care. However, we cannot guarantee the availability of the app or the services at all times. We are not liable for any loss or damage caused by interruptions to the app or services, including but not limited to, downtime for maintenance, repairs, or upgrades.
8.2 Foreseeable Loss or Damage
Subject to Clause 8.4, DocSelect is responsible for any foreseeable loss or damage caused by our breach of these Terms and Conditions. If we fail to comply with these terms, we are liable for any loss or damage you suffer that is a foreseeable result of our breach, or our failure to use reasonable care and skill. Loss or damage is deemed foreseeable if it was discussed by both parties when the contract was formed or is obvious from the circumstances.
8.3 Exclusions of Liability
DocSelect will not be liable for any loss or damage that is not foreseeable or for indirect losses, including but not limited to loss of income, business opportunities, or goodwill. DocSelect is also not liable for any data loss or damage that occurs due to the user’s failure to comply with the necessary technology or system requirements.
8.4 Exclusion of Liability for Personal Injury or Death
We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, or the negligence of our employees, agents, or subcontractors, and for fraud or fraudulent misrepresentation.
8.5 Third-Party Services
DocSelect may use third-party service providers to facilitate certain aspects of the services, such as payment processing or technical support. While we take reasonable steps to ensure the quality of these services, we are not responsible for any issues arising from the third-party services, including but not limited to, failures in payment processing or data storage.
8.6 Medical Advice and Responsibility
While DocSelect provides access to healthcare services, including consultations with medical professionals, the ultimate responsibility for medical decisions rests with the clinician and the patient. DocSelect is not liable for the outcome of medical decisions made based on consultations or advice provided through the app. You are responsible for ensuring that the services are appropriate for your health needs, and you should seek further advice if necessary.
8.7 Technology Issues and Data Loss
DocSelect is not liable for any damage or loss of data caused by the user’s failure to comply with the minimum system requirements or by issues arising from the user’s technology or internet connection. It is the user’s responsibility to ensure that their devices and systems are compatible with the app and that they have a stable internet connection.
8.8 Force Majeure
DocSelect will not be held liable for any failure or delay in performance of our obligations due to causes beyond our reasonable control, including but not limited to, natural disasters, pandemics, system failures, or acts of government or regulatory bodies.
8.9 Total Liability
Subject to Clause 8.4, the total liability of DocSelect to you in respect of all claims arising from these Terms and Conditions, whether in contract, tort, or otherwise, shall not exceed the total amount paid by you for the services in question in the 12 months preceding the claim.
9.1 Ownership of Content
All intellectual property rights in the DocSelect app, including but not limited to, trademarks, logos, designs, software, content, and data, are owned by DocSelect or licensed to us. These rights are protected by copyright, trademark, and other laws, and you are granted no rights to use them except as expressly stated in these Terms and Conditions.
9.2 Licence to Use the App
DocSelect grants you a personal, non-transferable, and non-exclusive licence to use the app for personal, non-commercial purposes. This licence allows you to access and use the services provided by DocSelect in accordance with these Terms and Conditions, but does not grant you any ownership rights in the app or its content.
9.3 Restrictions on Use
You are not permitted to:

Copy, modify, distribute, or create derivative works of the app or any content provided through the app, except as expressly authorised by DocSelect.
•
Use any part of the app or its content for commercial purposes without obtaining prior written consent from DocSelect.
•
Reverse engineer, disassemble, decompile, or otherwise attempt to discover the underlying code or structure of the app, except to the extent permitted by law.
•
Remove or alter any copyright, trademark, or other proprietary rights notices contained in the app or its content.
9.4 User-Generated Content
If you submit any content to DocSelect (e.g., reviews, feedback, or comments), you grant DocSelect a worldwide, royalty-free, irrevocable, and transferable right to use, reproduce, modify, and display that content in connection with the services provided through the app. You confirm that you have the necessary rights to grant DocSelect this licence.
9.5 Third-Party Content
The app may contain content or services provided by third parties. DocSelect makes no claim to ownership of third-party intellectual property, and users must comply with any applicable third-party terms and conditions in relation to such content. DocSelect is not responsible for any third-party content, and the inclusion of such content in the app does not constitute an endorsement.
9.6 Infringement of Intellectual Property
If you believe that any content provided by DocSelect infringes upon your intellectual property rights, please contact us at [Insert Contact Information] to notify us of the alleged infringement. We will investigate the matter and take appropriate action in accordance with applicable laws.
10.1 Termination by You
You may terminate this Agreement at any time by deleting your account, ceasing to use the DocSelect app, and notifying us of your decision to discontinue the use of the services. If you are on a subscription plan, you must provide at least 30 days’ notice before the end of the current billing period to avoid further charges.
10.2 Termination by DocSelect
DocSelect reserves the right to terminate or suspend your access to the app and services if:

You fail to provide necessary information requested by DocSelect, or provide incomplete or inaccurate information that prevents us from providing the services;
•
You engage in behaviour that is deemed abusive, illegal, or harmful to the app, its content, or other users;
We reasonably consider termination necessary for any other legitimate reason, including but not limited to, security concerns or non-payment.
10.3 Consequences of Termination
Upon termination of this Agreement, you will no longer have access to the DocSelect services or the app. For Pay-As-You-Go appointments, any outstanding payments for services already provided must still be settled. For Subscription Plans, you will be liable for any unpaid fees up to the point of termination, and no refunds will be provided for any unused portion of the subscription unless explicitly stated otherwise.
10.4 Data Retention and Deletion
Upon termination, we may retain your data for a period of time as required by law, or for legitimate business purposes, such as fulfilling any outstanding obligations or legal requirements. After that period, your personal and health data will be deleted from our systems, subject to applicable data retention policies.
10.5 Reinstatement of Services
If your account is suspended or terminated, and you wish to reinstate access to services, you must contact DocSelect customer support. We reserve the right to refuse reinstatement if the conditions leading to suspension or termination have not been resolved to our satisfaction.
10.6 Survival of Terms
Certain provisions of these Terms and Conditions will survive termination, including but not limited to, liability clauses, data retention, and any rights or obligations that, by their nature, should continue post-termination.
11.1 Complaints Process

11.2 Resolution of Disputes

11.3 Escalation of Disputes
If we cannot resolve the issue informally, we will attempt to resolve the dispute through mediation or a similar alternative dispute resolution (ADR) process, as appropriate. If these efforts do not result in a satisfactory resolution, either party may seek legal recourse through the courts, as set out in the governing law section.
11.4 Governing Law and Jurisdiction
These Terms and Conditions are governed by English law. You may bring legal proceedings in respect of the services provided through DocSelect in the English courts. If you live in Scotland, you may bring legal proceedings in either the Scottish or English courts. If you live in Northern Ireland, you may bring legal proceedings in either the Northern Irish or English courts.
12.1 Force Majeure
DocSelect will not be liable for any failure or delay in the performance of our obligations under these Terms and Conditions due to events beyond our reasonable control, including but not limited to, acts of God, fire, flood, war, terrorism, strikes, or any other event that makes it impossible or impractical for DocSelect to provide the services.
12.2 Severability
If any part of these Terms and Conditions is found to be unenforceable, illegal, or void, the remaining provisions will continue in full force and effect. The unenforceable part will be modified or replaced with a valid provision that most closely reflects the intent of the original.
12.3 Waiver
Any failure or delay by DocSelect in enforcing any part of these Terms and Conditions will not constitute a waiver of its right to do so in the future. DocSelect reserves the right to take action as and when necessary, despite any previous delay.
12.4 Entire Agreement
These Terms and Conditions, along with any other policies or terms referenced within them, represent the complete agreement between you and DocSelect. They supersede any prior agreements, communications, or understandings regarding the use of the DocSelect app or services.
12.5 Transfer of Rights and Obligations
You may not transfer any of your rights or obligations under these Terms and Conditions to another party without the prior written consent of DocSelect. DocSelect reserves the right to assign or transfer its rights and obligations to any third party at its discretion.
